Terms of Service

Please read these Terms of Service ("Terms") carefully before using BlurIt mobile application and browser extension (collectively, the "Services") operated by TOSS (The Otherside Studios) ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using BlurIt, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

BlurIt is a suite of privacy tools that allows you to:

• Edit and blur images with various modes (Blur, Mosaic, Gaussian, Pixelate, Box, Motion)
• Capture browser tabs or select local images for instant editing
• Save edited images or copy them directly to your clipboard
• Access Pro features across mobile and desktop platforms with a single purchase

3. User Accounts

BlurIt does not require user accounts. The App operates anonymously and does not collect personal identification information. Purchase and subscription data is managed through your app store account (Google Play or Apple App Store).

4. Free and Pro Versions

4.1 Free Version

The free version of BlurIt includes:

• Basic blur mode
• Blur strength levels 5 and 10
• Brush sizes 10 and 20 pixels
• All core editing features
• Interstitial advertisements (shown after natural break points)

4.2 Pro Version

The Pro version (BlurIt Pro) is available as a one-time lifetime purchase and includes:

• All 6 blur modes (Blur, Mosaic, Gaussian, Pixelate, Box, Motion)
• All blur strength levels (5, 10, 15, 20)
• All brush sizes (10, 20, 40, 60 pixels)
• Complete removal of all advertisements
• Lifetime access with no recurring fees

5. In-App Purchases

5.1 Purchase Process

• Pro subscriptions are processed through RevenueCat and your app store (Google Play or Apple App Store)
• All purchases are subject to your app store's terms and conditions
• Payment is processed securely through your app store account
• We do not collect or store payment card information

5.2 Purchase Terms

• BlurIt Pro is a one-time lifetime purchase
• Once purchased, Pro features remain active for the lifetime of the App
• Purchases are linked to your app store account and can be restored on any device
• Refunds are subject to your app store's refund policy

5.3 Restoring Purchases

• You can restore your Pro purchase at any time through the App's settings
• Restoration requires the same app store account used for the original purchase
• If you have issues restoring, contact support@theothersidestudios.com

6. Advertising

6.1 Free Version Ads

• Free users will see interstitial advertisements
• Ads are shown after natural break points (after blur operations complete)
• Ad frequency is capped (minimum 30 seconds between ads)
• Ads are served by Google AdMob and are subject to Google's advertising policies

6.2 Pro Version

• Pro users do not see any advertisements
• All ads are permanently removed upon Pro purchase

7. User Content and Images

7.1 Image Processing

• You retain all rights to images you edit using BlurIt
• Images are processed entirely on your device - no images are uploaded to our servers
• We do not access, view, or store your images
• You are solely responsible for the images you choose to edit

7.2 Prohibited Use

You agree not to use BlurIt to:

• Edit or process images that violate any laws or regulations
• Create content that infringes on intellectual property rights
• Process images containing illegal, harmful, or offensive content
• Use the App for any unlawful purpose

8. Intellectual Property

8.1 App Ownership

BlurIt, including its design, features, and functionality, is owned by TOSS (The Otherside Studios) and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain all ownership rights to images you create or edit using BlurIt. We do not claim any ownership over your content.

8.3 Third-Party Services

BlurIt uses third-party services including:

• RevenueCat & Whop: For subscription and purchase management
• Supabase: For account management and cross-platform synchronization
• Google AdMob: For advertising services (mobile only)

These services are subject to their respective terms of service and privacy policies.

9. Disclaimers and Limitations

9.1 Service Availability

• We strive to keep BlurIt available and functional, but we do not guarantee uninterrupted access
• The App may be unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify, suspend, or discontinue the App at any time

9.2 No Warranty

BlurIt is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

• The App will meet your specific requirements
• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or other harmful components

9.3 Limitation of Liability

To the maximum extent permitted by law, TOSS (The Otherside Studios) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of BlurIt.

10. Indemnification

You agree to indemnify and hold harmless TOSS (The Otherside Studios) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of BlurIt or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Your continued use of BlurIt after changes constitutes acceptance of the modified Terms.

12. Termination

12.1 By You

You may stop using BlurIt at any time by uninstalling the App from your device.

12.2 By Us

We reserve the right to terminate or suspend your access to BlurIt at any time, with or without cause or notice, for any reason, including violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TOSS (The Otherside Studios) operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or BlurIt shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TOSS (The Otherside Studios) regarding your use of BlurIt and supersede all prior agreements and understandings.

If you downloaded BlurIt from Google Play or the Apple App Store, you also agree to:

• Google Play Terms of Service (for Android users)
• Apple Media Services Terms and Conditions (for iOS users)
• Your app store's refund and cancellation policies

In case of conflict between these Terms and your app store's terms, your app store's terms shall govern with respect to purchase and payment matters.
